Ninth Circuit Awards Equal Access to Justice Act (EAJA) Fees PDF Print E-mail
Thangaraja v. Gonzales, (9th Cir. November 3, 2005)

Petitioner, a Tamil native and citizen of Sri Lanka, applied for asylum and withholding of removal in immigration proceedings. The immigration judge denied her applications and the BIA summarily affirmed the denials without opinion. Petitioner filed a petition for review with the court of appeals. The court of appeals granted the petition for review and remanded the case to Board for further proceedings. Petitioner timely filed a motion for attorneys' fees and costs under the Equal Access to Justice Act (EAJA).

THE PRESIDENT: Thank you all. Please be seated. Thank you for the warm welcome. It is such a pleasure to be back in Arizona, and it's great to be here in Tucson. The last time I was here I think there was probably about a 50-degree temperature differential. It's an honor to stand here with the men and women of Davis-Monthan Air Force Base. As well, to be here with the men and women of the Customs and Border Protection Agency, and the Immigration and Customs Enforcement Agency, as well.
